The USER’s acceptance of the terms and conditions of the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL is an essential condition to access and use the VALE VOLUNTEERS PORTAL.

By manifesting their acceptance, the USER agrees to all terms and conditions of the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL, with no restrictions and/or exceptions of any kind.

On the purpose of the Vale Volunteers Portal

The Vale Volunteers Portal has the purpose of bringing together and integrating various users who aim to implement social and philanthropic projects in volunteer actions.

The Vale Volunteers Portal functions as a communication platform amongst its users so as to allow:

  1. the dissemination of various social actions;
  2. the presentation social action volunteer opportunities;
  3. the dissemination of actions implemented and/or under implementation.

On the USER

The Vale Volunteers Portal is meant to be used by companies and individuals who intend to implement social and philanthropic projects and develop volunteer actions.

In the case of corporate entities, the company will be solely responsible for nominating one or more persons who will have access to the Vale Volunteers Portal. These persons will be designated users linked to the company they represent.

In the case of individuals, the Vale Volunteers Portal can be used by anyone over 12 years of age. The participation of those under 12 is forbidden, except when the Vale Volunteers Portal understands, solely and exclusively according to its own criteria, that said participation is justified due to relevant social, philanthropic or volunteer action.

The Vale Volunteers Portal may deny, with no prior or posterior justification, access and use of the Vale Volunteers Portal.

Corporate entities are responsible for the activities of their users linked to the Vale Volunteers Portal.

The acceptance of the terms and conditions in this document by the users is extended to the companies represented by said users.

On the use of the Vale Volunteers Portal

The Vale Volunteers Portal is to be exclusively used by the users registered in the Vale Volunteers.

The use of the Vale Volunteers Portal is aimed at the purposes established in the clause On the Purpose of the Vale Volunteers Portal. Any activity that is not in accordance to this set of norms is prohibited.

The use of the Vale Volunteers Portal by the users is conditioned to completely filling out the USER registry for the Vale Volunteers. The USER data will be treated in accordance to the conditions established in the clause Privacy Policy.

USER Registration and Privacy Policy

To use the Vale Volunteers Portal the USER must correctly fill out the registration form. The USER is responsible for updating the data.

The USER data collected by the Vale Volunteers Portal will only be used by the Vale Volunteers Portal, with the main purpose of developing and improving the Vale Volunteers Portal services.

The Vale Volunteers Portal will not disseminate, transfer or commercialize, at any time and for any reason, personal user data present in the registration forms.

Notwithstanding, the Vale Volunteers Portal may disseminate, at any time and for any reason, all user actions present in the open and/or exclusive user areas.

Through legal determination, the Vale Volunteers Portal will provide all USER registered information, within the limits of the abovementioned determination.

The Volunteers Portal may use USER registration data to form user profiles for the Vale Volunteers Portal, which will be used to disseminaste the Vale Volunteers Portal to third parties.

Norms of Conduct

The USER is forbidden to use the Vale Volunteers Portal for any activity, even of legal, that is in conflict with the Usage Norms of the Vale Volunteers Portal, along with the following activities:

  1. to disseminate and offer, freely or at a cost, goods and services of any nature;
  2. to use crude words in any area of the Vale Volunteers Portal;
  3. to practice, disseminate, and stimulate illegal activities of any nature, be they of a civil or criminal nature;
  4. to disrespect public and moral order and good manners;
  5. to invade the privacy of other users;
  6. to use name and/or identification that is not that of the USER themselves;
  7. to disturb the order of the Vale Volunteers Portal and its users.
    1. The USER is obliged to prevent third parties to use their access to the Vale Volunteers Portal, and is prohibited, facing consequences, of transferring, loaning and/or disseminating their access data to third parties.

      If the USER becomes aware of misuse of their data to gain access to the Vale Volunteers Portal, said fact must be immediately reported to the Vale Volunteers Portal administrator so that the necessary actions might be taken to prevent the unauthorized use of USER data and the Vale Volunteers Portal.

      The USER is forbidden to register more than once in the Vale Volunteers Portal. As such, each USER will be individually identified and have unique and exclusive access data.

      When using texts, photos, and other work by third parties, the USER must necessarily obtain the adequate permits for the use of said work and the authorization for the use of image of third parties.

      Any copyright violation of third parties will be the USER’s responsibility, who is subject to the conditions of the Intellectual Property clause.

      Intellectual Property

      Names, commercial names, trademarks, logos, designs, photos, visual identity, files, software, and any other object electronically made available at the Vale Volunteers Portal, be they or not accessible to the users, are owned by the Vale Volunteers Portal and/or third parties and are subject to the Brazilian norms regarding intellectual property.

      The Vale Volunteers Portal user’s are expressly forbidden of using intellectual origin property of third parties at any time and for any reason except with the expressed authorization of the Vale Volunteers Portal, its users, partners, or third party holders of said property.

      The use of the abovementioned property without due authorization of its holders will be a violation of intellectual property rights, and the violater will be subject to the civil and criminal sanctions adequate and foreseen in the specific legislation that regulates the matter.

      The USER is obligated to maintain the Vale Volunteers Portal exempt of any responsibility with respect to the violation of intellectual property rights as a result of an action or omission on the part of the USER, according to the terms foreseen in the Special Responsibility Clause.

      Special Responsibility Clause

      The USER is obliged to maintain the Vale Volunteers Portal, its maintaining entities, associates, directors, and employees, free of all and any responsibility regarding any damages and impairmants caused directly and/or indirectly to the USER, including in reference to legal fees, restitution, and compensations of any kind, at any time and for any reason.

      The same applies to illicit, civil and/or criminal act carried out by the USER in the Vale Volunteers Portal, by the USER’s action and/or omission.

      On USER disconnection

      The Vale Volunteers Portal is reserved the right to cancel USER registration and access to the Vale Volunteers Portal, completely and/or partially, at any time, with no need for prior notice to the USER and/or any type of justification.

      The incompliance of any provision of the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL will cause immediate disconnection of the USER and, consequently, the prevention of access to the Vale Volunteers Portal.

      Notwithstanding, the USER may request the Vale Volunteers Portal to reconsider the decision on their disconnection.

      A possible violation of the provision in the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL can be resolved by the USER at any time. The USER may request reconsideration of the removal including evidence of the solution of the pending matter or violation.

      The Vale Volunteers Portal, in a sovereign manner, according to their own criteria, and in the terms and condition foreseen in the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL, will decide on the definitive cancellation of USER access to the Vale Volunteers Portal or, on the other hand, their readmission.

      The decision to readmit the USER into the Vale Volunteers Portal expresses a mere act of liberty of the Vale Volunteers Portal, and does not represent, in any form, any kind of alteration in the terms and conditions of the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL.

      Likewise, the readmission of the USER will not represent the Vale Volunteers Portal agreement with the action or omission that led to the removal of the USER. The USER will maintain all of their obligations as stated in the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL, mainly with respect to the responsibilities and consequences derived from illicit actions. The USER is subject to the sanctions and responsibilities foreseen in the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL.

      On concluding the operations of the Volunteer Portal

      The definitive and/or temporary conclusion of the Vale Volunteers Portal activities will not result in any kind of obligation, of any nature, of the Vale Volunteers Portal towards the USER, including with respect to the prior communication of said fact, compensation, payment, and/or restitution, at any time and for any reason.

      Applicable Legislation and Court

      This USAGE NORMS OF THE VALE VOLUNTEERS PORTAL, the usage of the Vale Volunteers Portal, and the relations between the USER and the Vale Volunteers Portal are subject to the Brazilian legislation in effect.

      The USER agrees to select, along with the Vale Volunteers Portal, the Central Court of Comarca in the City of Rio de Janeiro as the only one competent to address any doubts and/or conflict originated from this USAGE NORMS OF THE VALE VOLUNTEERS PORTAL and also from the use of the Vale Volunteers Portal, expressly renouncing any other, no matter how privileged.
