The USER is obliged to prevent third parties to use their access to the Vale Volunteers Portal, and is prohibited, facing consequences, of transferring, loaning and/or disseminating their access data to third parties.
If the USER becomes aware of misuse of their data to gain access to the Vale Volunteers Portal, said fact must be immediately reported to the Vale Volunteers Portal administrator so that the necessary actions might be taken to prevent the unauthorized use of USER data and the Vale Volunteers Portal.
The USER is forbidden to register more than once in the Vale Volunteers Portal. As such, each USER will be individually identified and have unique and exclusive access data.
When using texts, photos, and other work by third parties, the USER must necessarily obtain the adequate permits for the use of said work and the authorization for the use of image of third parties.
Any copyright violation of third parties will be the USER’s responsibility, who is subject to the conditions of the Intellectual Property clause.
Intellectual Property
Names, commercial names, trademarks, logos, designs, photos, visual identity, files, software, and any other object electronically made available at the Vale Volunteers Portal, be they or not accessible to the users, are owned by the Vale Volunteers Portal and/or third parties and are subject to the Brazilian norms regarding intellectual property.
The Vale Volunteers Portal user’s are expressly forbidden of using intellectual origin property of third parties at any time and for any reason except with the expressed authorization of the Vale Volunteers Portal, its users, partners, or third party holders of said property.
The use of the abovementioned property without due authorization of its holders will be a violation of intellectual property rights, and the violater will be subject to the civil and criminal sanctions adequate and foreseen in the specific legislation that regulates the matter.
The USER is obligated to maintain the Vale Volunteers Portal exempt of any responsibility with respect to the violation of intellectual property rights as a result of an action or omission on the part of the USER, according to the terms foreseen in the Special Responsibility Clause.
Special Responsibility Clause
The USER is obliged to maintain the Vale Volunteers Portal, its maintaining entities, associates, directors, and employees, free of all and any responsibility regarding any damages and impairmants caused directly and/or indirectly to the USER, including in reference to legal fees, restitution, and compensations of any kind, at any time and for any reason.
The same applies to illicit, civil and/or criminal act carried out by the USER in the Vale Volunteers Portal, by the USER’s action and/or omission.
On USER disconnection
The Vale Volunteers Portal is reserved the right to cancel USER registration and access to the Vale Volunteers Portal, completely and/or partially, at any time, with no need for prior notice to the USER and/or any type of justification.
The incompliance of any provision of the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL will cause immediate disconnection of the USER and, consequently, the prevention of access to the Vale Volunteers Portal.
Notwithstanding, the USER may request the Vale Volunteers Portal to reconsider the decision on their disconnection.
A possible violation of the provision in the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL can be resolved by the USER at any time. The USER may request reconsideration of the removal including evidence of the solution of the pending matter or violation.
The Vale Volunteers Portal, in a sovereign manner, according to their own criteria, and in the terms and condition foreseen in the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL, will decide on the definitive cancellation of USER access to the Vale Volunteers Portal or, on the other hand, their readmission.
The decision to readmit the USER into the Vale Volunteers Portal expresses a mere act of liberty of the Vale Volunteers Portal, and does not represent, in any form, any kind of alteration in the terms and conditions of the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL.
Likewise, the readmission of the USER will not represent the Vale Volunteers Portal agreement with the action or omission that led to the removal of the USER. The USER will maintain all of their obligations as stated in the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL, mainly with respect to the responsibilities and consequences derived from illicit actions. The USER is subject to the sanctions and responsibilities foreseen in the USAGE NORMS OF THE VALE VOLUNTEERS PORTAL.
On concluding the operations of the Volunteer Portal
The definitive and/or temporary conclusion of the Vale Volunteers Portal activities will not result in any kind of obligation, of any nature, of the Vale Volunteers Portal towards the USER, including with respect to the prior communication of said fact, compensation, payment, and/or restitution, at any time and for any reason.
Applicable Legislation and Court
This USAGE NORMS OF THE VALE VOLUNTEERS PORTAL, the usage of the Vale Volunteers Portal, and the relations between the USER and the Vale Volunteers Portal are subject to the Brazilian legislation in effect.
The USER agrees to select, along with the Vale Volunteers Portal, the Central Court of Comarca in the City of Rio de Janeiro as the only one competent to address any doubts and/or conflict originated from this USAGE NORMS OF THE VALE VOLUNTEERS PORTAL and also from the use of the Vale Volunteers Portal, expressly renouncing any other, no matter how privileged.
